This enumeration paraphrases Article L112-2 from the Intellectual Property Code, which provides a non-exhaustive list of intellectual works whose protection can be covered by copyright, provided this work is original, i.e. reflects a part of the author’s personality.
HOW TO PROTECT YOUR INTELLECTUAL PROPERTY?
Copyright does not depend on official procedures since a created work is considered to be protected as soon as it exists; but to assert copyright on your work, you will have to prove that you are the author and date it for this purpose.
Copyright expires 70 years after the author’s death.
With the assistance of a bailiff, Cabinet GUIU will give your creations a date, which will serve as prima facie evidence in a court of law. Your creations can either be finished works or mere outlines.
THE RIGHTS PROVIDED BY COPYRIGHT
Copyright provides the authors of creative works – and their heirs - with two types of rights: moral rights and economic rights.
The moral rights of the author include the right to "the respect of his name, of his status as author, and of his work" (Art; L121-1 from the Intellectual Property Code), i.e:
The right of publication: the author only may decide when his work will be disclosed to the public (Art. L121-2).
The right of attribution: the author has the right to have his name stated on the work.
The right to the respect of the work: the author may object to any modification of the work
The right of withdrawal: the author may prevent further reproduction, distribution or representation (Art. L121-4).
The economic rights of the author allow him or her to exploit the work and benefit from a proportional share of the remuneration flowing from the exploitation of this work. The author has the exclusive right to authorize or prohibit the reproduction of the work and its public performance.
These economic rights are transferable to a third party.
Cabinet GUIU assists you in the drafting of contracts (publishing contracts,… ) and advises you on any issue related to the transfer of rights…
PIRACY - PLAGIARISM
Never before the beginning of the Internet era were copyrights so breached than they are now. Piracy kills creation… and is punishable by law.
Cabinet GUIU defends your rights and tries to find a friendly settlement in case of litigation.
